GENERAL TERMS AND CONDITIONS (GTC)

1. Introduction

Use of this website assumes your agreement with our Terms and Conditions please take the time to review them.

These General Terms and Conditions apply to all and any product (for example art object) or service (for example course, workshop and/or event) transaction between ReCreArte.ch (operated by Cressentia AG and in the following referred to as ReCreArte) and a customer (end-consumer or corporate customer). This specifically also includes the purchase of event/course/workshop tickets, vouchers and products from www.recrearte.ch . With the purchase of any product or service from ReCreArte or with the verbal or written acceptance of an offer (for example for a bespoke event), the customer accepts these terms and conditions. 

 

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

ReCreArte is a working title, and is operated by Cressentia AG, at Via della Gallinazza 10y, 6600 Locarno (TI), Switzerland.

4. Products and Services

ReCreArte offers the following products and services:

  • Painting, drawing and crafting classes or workshops, as well as similar events in the domain of arts and creativity (e.g. Creative team building projects, etc) for children, teenagers and adults. 

    • Private customers purchase admittance to the events either through the purchase of a ticket (see section “Event-Tickets”) or by redeeming a voucher (see section “Vouchers”).  

    • Events for corporate customers are based on the acceptance of a written offer created by ReCreArte for the customer. Additional terms and conditions may be stipulated in this offer that will complement or overwrite conditions in these general terms and conditions. 

  • Consumer products related to the events (i.e. arts and crafts supplies) may be sold via www.recrearte.ch or directly at an event.

  • Course descriptions are individually specified in each case on the ReCreArte website, along with specific start date and time, location, contents, requirements and other course details. ReCreArte reserves the right to adapt the organization to circumstances during the course.

  • ReCreArte reserves the right to make enhancements to improve the courses. In this sense, content and prices are subject to change. A paid and confirmed course registration will be honoured at the rate applicable on the day of purchase.

  • Instructors or course leaders are persons listed on the ReCreArte website and mostly specified in the course description. ReCreArte reserves the right to change the course instructor last minute due to health reasons or other impediments, without ReCreArte having the obligation to inform the participants in advance. These instructors may be artists, photographers, and other external freelancers who have collaboration agreements with ReCreArte.  

  • ReCreArte is a creative studio with a gallery that displays and sells are objects created by ReCreArte employees and other interested artists. 

  • Participants to an event, course or workshop agree to unclaimed paintings, canvases and other works of art created in the courses (for children, teenagers and adults) will be disposed of after 3 months. For any damage and / or loss is excluded any liability.



 

5. Event-Tickets

  • Participation at an event requires the prior purchase of a ticket either directly from ReCreArte or via a partner. 

  • The ticket gives the holder of it the right to participate in the event listed on the ticket (on the date and time listed on the ticket). Rescheduling to a different event is only possible in accordance to the conditions in the section “Rescheduling”.

  • ReCreArte reserves the right to cancel events if the number of participants is below a certain minimum. This is regulated according to paragraph “Minimum Number of Participant”. 

  • Ticket prices are specified in the course/event description and include VAT on the website: www.Recrearte.ch. The payment and applicable terms and conditions indicated in each case and also communicated via link to this page on the confirmation e-mail that is sent upon purchase of a course.

  • Re-Scheduling: We offer re-scheduling to a different event of the same price category as follows:

    • Up to 7 days before the event start free of charge. 

    • Between 7 days and up to 48 hours before the event for an administrative fee of 10 CHF.

    • Re-scheduling requests received between 48h and 24h before the event are subject to a fee of 20 CHF. 

    • Re-schedule requests received later than 24 hours before the event unfortunately cannot be granted. Re-scheduling request need to be made via: www.recrearte.ch/en/reschedule

  • Cancellation: Once purchased, tickets are non-refundable, only rescheduled, or exchanged for a voucher of corresponding value, according to the re-scheduling time-conditions listed above.

 

6. Vouchers

  • These conditions apply to vouchers purchase directly from ReCreArte. Vouchers purchased from third parties (e.g. Amici di Ticino) are subject to the terms and conditions of this party. 

  • The purchase of a voucher gives the owner of the voucher the right to the product or service named on the voucher. In case a voucher specifies a cash CHF value, it gives the owner the right to redeem this for any product or service of the same value. 

  • If the holder of a voucher redeems it for a product or service of lower value than the voucher value, the remaining value can be redeemed for further products or services at a later date. If the holder of a voucher redeems the voucher for a product or service that has a higher value than the voucher value, the customer needs to pay the difference. 

  • Vouchers are transferrable. 

  • The value of each voucher can only be redeemed once.

  • Depending on availability, vouchers can be delivered electronically via PDF or physically via post. For physical vouchers additional cost for packing and shipping may apply. 

  • Vouchers are issued without VAT. If applicable, VAT applies once the voucher is exchanged for a product or service.

  • Redeeming Vouchers: Vouchers can be redeemed via Email (info@recrearte.ch) or, if they contain a code, directly on www.recrearte.ch as a form of payment. Once a voucher is exchanged for a ticket the conditions set-forth under “Event-Tickets” apply.

  • Validity: Vouchers are generally valid for 3 years starting from the date of purchase. 

 

7. Use of the Online Shop

Tickets and vouchers are sold via the online shop of ReCreArte.ch. Payment is handled via industry standard secure connections directly via the payment handler. ReCreArte never stores any payment information on its servers.

 

8. Minimum age, skill level and health

  • Depending on the nature of the event a certain minimum age or skill level may be required (e.g. nude painting workshops). However, most events are not subject to age or skill level restrictions. 

  • It is important to clarify that events for Kids are available as of the age of 5, but kids between the ages of 5 and 7 years of age require the presence of an accompanying adult. Children as of 8 years of age may attend the course unaccompanied but parent(s) agree through these terms and conditions to the child being able to leave the premises alone, at the time foreseen as the end of the course/event. 

  • As Teens we understand children as of the age of 13. Some courses may specify a minimum age considered needed for the content of the course, but this will be an exception.

  • For events held in the evenings (after 18:00), we recommend a minimum age of 16 for unaccompanied participation. In company of an adult, children may participate in any event (exception: age-restricted events).

  • Prerequisites for course participation: In most cases, no special (or prior) knowledge is required unless specified in the course description. 

 

Health and insurance

  • By registering, course participants confirm that their health allows them to attend the course in such a way that neither their health nor the course itself is endangered.

  • Course participants and their legal representatives confirm that they have sufficient insurance coverage. The ReCreArte declines any liability. These are in particular: liability for accidents, injuries, theft and other possible damages.

  • The use of the facilities and rooms of ReCreArte is at your own risk.

 

9. Minimum number of participants

  • ReCreArte reserves the right to cancel events if the number of registered participants is below a certain minimum. Unless otherwise stated this minimum number is 5 people. 

  • If this number of registrations is not reached 72 hours before the event, ReCreArte will typically cancel the event. 

  • If ReCreArte cancels an event, the customer will be offered the following options: 

    • The value of the original ticket may be exchanged for a voucher that can be exchanged for any other event. 

    • The customer can choose a full refund (either via the method that was used to purchase the ticket or via bank transfer). 

 

10. Deviations from the service description and cancellations by ReCreArte 

  • ReCreArte reserves the right to minor deviations from the original service description of the event. Minor deviations include (but are not limited to) the change of the instructor, the change of the event location up to 3 km, the change of the event time by up to 1 hour. Such changes will be communicated as early as possible. 

  • For major deviations of the service description (for example change of time by more than 1 hour or change of location of more than 3 km) or in case of very short notice of any changes, the customer is entitled to request a full refund or an exchange for a voucher. 

  • ReCreArte reserves the right to cancel events due to major impediments, or external restrictions (for example sickness of the instructor or official measures imposed, force majeure, security concerns). In such cases, the customer may request a full refund or an exchange for a voucher. 

  • ReCreArte does not assume any costs incurred by participants due to cancellation or discontinuation of the event/course.

 

11. Private Event cancellation times and applicable fees

  • Private Event Cancellation Times and Applicable Fees

  • In case of changes to the number of participants or full cancellation from a confirmed booking of a private event by the requesting party (confirmation of booking takes place via e-mail), the following cancellation fees are due:

    • up to 30 days before the start of the service (course, workshop, event) 30 %;

    • up to 20 days before the start of the service (course, workshop, event) 50 %;

    • up to 10 days before the start of the service (course, workshop, event) 70 %;

    • up to 3 days before the start of the service (course, workshop, event) or in case of no-show 100 %;

  • in each case of the invoice amount paid or owed. The remaining amount will be refunded to the booking party’s account (transaction costs to be borne by the booking party). 

  • The date and time of the corresponding course will be considered as the start of the service/event. Cancellation must be made in writing; the date of receipt of the notice of cancellation at the registered location of ReCreArte (Via della Gallinazza 10b, 6600 Locarno) is considered the deadline. Email with returned-receipt notice can also be used. If participants do not make use of individual services booked, they are not entitled to a reduction of the total price.

 

12. Language of Instruction at the Events

The language of instruction of events is specified in the event description. Many events are held primarily in English, but support in other languages is also provided as most instructors are multi-lingual and will accommodate for spontaneous translation to German, Spanish, French and/or Italian depending on the languages spoken by the instructor(s). It may occur that some events are held only in English or only in German – please refer to the event description before purchasing a ticket. 

 

13. Exclusion from the course

Course participants are obliged to abide by the rules of the studio. ReCreArte reserves the right to exclude participants from the course for good reason. Course participants will be warned in writing in case of a violation of the rules.

 

After a second violation, the course participant will be expelled. Immediate expulsion will occur in the event of the consumption of illegal substances before or during the course, as well as deliberate disruption of the course. In such cases, after an exclusion from the course, the course fee will not be refunded.

 

14. Photo and Video Recordings

ReCreArte will occasionally take photos or make video recordings during the events that may include the participants and/or their work of art. When purchasing an event ticket the customer agrees to ReCreArte using such photos or videos for advertisement purposes. Customers may revoke this right orally or in writing – in which case ReCreArte will honour the requests by deleting the photo or video in question.

 

15. Website Content & Copyrights

  • All contents of this website may be subject to changes, reviews or errors. The content (texts and photos) of this website is subject to copyright. The use, editing or distribution without the consent of the creator is not allowed. 

 

  • We are not responsible for republished content from this blog on other blogs or websites without our permission.

 

  • Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

We are always delighted when you sign up to receive the ReCreArte Newsletter, which we will be sending out monthly. You may have signed up via our online form on our website or when you opted in to receive a subscriber only perk such as a free printable.

 

Through our Newsletter we share our newest arts, crafts and activities and links to older seasonal posts that might be of particular interest at that time. Occasionally we may include product promotions or links to products where we are affiliates and may receive a small commission if you make a purchase.

 

We ask for your name and email so that we can address our newsletters to you and send them to your inbox. We never share these email addresses with third-party companies.

 

We use WIX to store and manage this email list, but these emails are not used by WIX for their own purposes. You can of course unsubscribe from our newsletter (opt-out) at any time. Click the unsubscribe button at the bottom of any newsletter or email us at info@recrearte.ch and we can do it for you. This will permanently delete your email from our list.

 

From our newsletter, pages that you visit and actions that you take within the emails are tracked. This enables us to understand which emails are most relevant to you and helps us provide a more personalised and tailored service.

 

We also collect a user’s email address when they make a purchase or book an event on our website. This email will be used to communicate information about your purchase or event and possibly promote additional products or services. ReCreArte.ch uses Google Analytics to track visitor numbers to our website and their behaviour.
